Account termination

his/her account without any prior notice. PhoneCardShop.com.au may contact with
the user, if his/her profile information seems suspicious.
Validity of the calling Cards
PhoneCardShop.com.au does not represent any calling card/Phone card company in
any form or shape.
We are agents for the calling cards of our suppliers, which we resell to the end
user. Therefore if you have any issues or problems with your calling card, you
must contact the relevant Customer Service department of each card provider. The
contact numbers are listed on our web site and also sent to you with your PIN
numbers. Card expiration varies by issuer and details may be found by calling
the customer service number of the phone card company. No refund or replacement
is provided for lost, stolen or expired cards or unauthorised usage.
Liability
PhoneCardShop.com.au is not liable to you for any injury, loss or damage, which
including any indirect or consequential loss or damage that you may suffer using
our service.
Receipt of calling card PIN
Delivery of phone card pins will take place instantly after the purchase. The
customers will be provided with the pin numbers and other necessary information
in three different methods. Right after the purchase, the customer will be able
to view or, print the pin numbers. Same information will also be displayed under
My Account -> Review Previous Orders page.
Best thing is they will also receive a purchase summary email with PIN numbers
instantly after purchase. PhoneCardShop.com.au will send Pin number/numbers by
email only after successful completion of payment.
You are responsible to ensure that the email address that you have registered
with us is active, valid and up to date. We take no responsibility for
non-receipt or loss and theft of the calling card details once it is sent to
your registered email address.
If you have lost your calling card details once you had successfully received
it, you can request for a re-send. However, those details can only be re-sent to
the same email address that was used previously.
-If the System failed to send you calling card number for any reason,
PhoneCardShop.com.au will send your number with in 48 hours, and it is the
user's responsibility to notify PhoneCardShop.com.au about this matter by
emailing at info@PhoneCardShop.com.au
If the user has complains about any of the transaction that has been made,
he/she has to notify as soon as possible.
Calling card Purchase Limit
To minimise fraudulent credit card use on our website, we limit our customers to
a maximum of $10 or $100 worth of purchase everyday. If you wish to increase
your daily limit, please contact us at

Customer verification
To minimise the fraudulent credit card use, all the new accounts will not be
activated automatically and new customers after registration will not be able to
buy phone cards until we verify there details over the phone.
In order for us to verify your details and activate your account, please make
sure you have entered correct contact details.
Calling rates and accuracy of information on our website(s)
We endeavour to ensure that all information available on our website is
accurate. However, certain information is subject to change.
Calling card/Phone card calling rate or information of any calling card are
subject to change without any prior notice. If any such change occurs more
information can be collected by calling the customer service number of the
particular card company.
We do not accept liability for any errors or/and omissions, and reserve the
right to change specifications, information and description of listed products.

PCS Footy Tipping
Competition Terms & Conditions

The below terms and conditions apply to all new accounts created, existing
accounts reactivated and current accounts where tips are submitted for the
first time in a given season, in PCS Footy Tipping Competition, on or after
16th March 2008.

Entries and Participants not complying with these Terms & Conditions of
Entry are ineligible and the PhoneCardShop reserves its absolute right to
disqualify any Participant from the PCS Footy Tipping Competition if any
entries do not comply with these Terms & Conditions of Entry.

In these Terms & Conditions of Entry, unless the contrary intention appears,
the following words and phrases have the meanings set out opposite them:
“Away Team” means the team
that is listed by the sporting PCS Footy Tipping Competition as playing away
from their home ground. If the PCS Footy Tipping Competition does not nominate
an Away Team, the Away Team will be nominated at the discretion of the
PhoneCardShop.
"PCS Footy Tipping
Competition" means the series of Matches of the sport listed on PhoneCardShop.
"Match" means a single
game conducted by the relevant PCS Footy Tipping Competition, between member
teams of that round, in a Season;
“PCS” means PhoneCardShop
"Participant" means a
person who is eligible to participate in the PCS Footy Tipping Competition and
registers for or participates in the PCS Footy Tipping Competition;
"PCS Footy Tipping
Competition" means a tipping competition for any Season of Matches, or a given
Round in a Season, of any
PCS Footy Tipping Competition run on the Web Site whereby winning entries
are based on the Results of Matches at the conclusion of the relevant Round or
Season, as the case may be;
"Results" are the results
of Matches as officially determined by the relevant PCS Footy Tipping
Competition in accordance with the rules of that PCS Footy Tipping Competition
following the completion of a Round;
"Round" means a round of
the relevant PCS Footy Tipping Competition conducted during that PCS Footy
Tipping Competition's Season;
“Season” means the series
of home and away games (or series of Matches as indicated otherwise on the Web
Site) for a PCS Footy Tipping Competition as listed in the “Tipping” area of the
Web Site;
"Score" means the
allocation of points to a Participant for the correct selection of winning teams
as defined by the website;
"Web Site" means the Web
Site of the PhoneCardShop at http://www.PhoneCardShop.com.au accessible on the
Internet through the World Wide Web.

The PCS Footy Tipping Competition is open to residents of Australia (and
other countries where the law allows residents to enter Footy Tipping
Competitions of this nature). Entry into the PCS Footy Tipping Competition
is free. Each registered Participant may only place one set of tips per
Round in each PCS Footy Tipping Competition/Season. If there is a dispute as
to the identity of an applicant or Participant, the PCS reserves the right,
in its sole discretion, to determine their identity.

Entry into any PCS Footy Tipping Competition conducted on the Web Site is
available for PCS registered users, as specified on the Web Site anytime
during the relevant Season, provided there is one game within the final
Round that has not commenced. Entry into any PCS Footy Tipping Competition
is considered to occur when a Participant submits one or more tip(s) for any
of the Matches available for any Round.

The PCS however reserves the right not to accept registration for any
Participant if the registration contains anything slanderous or defamatory
or is otherwise unsightly in any way, as determined by the PCS in its
absolute discretion. Likewise, the Participant’s participation in the PCS
Footy Tipping Competition can be withdrawn due to unsightly conduct during
the course of the PCS Footy Tipping Competition , or after the PCS Footy
Tipping Competition has ended but before the prizes have been awarded, at
the PCS’s absolute discretion.

To enter any PCS Footy Tipping Competition for any particular PCS Footy
Tipping Competition, a Participant must either (i) register their details
via the on-line registration form located on the Web Site, (ii) login to the
Web Site with their username and password for an existing registration.
-
Any cost associated with accessing the Web Site is the Participant’s
responsibility and is dependent on the Internet service provider used. A
Participant electing to access the Web Site via wireless platforms for the
purpose of registering for and/or entering tips may be subject to content
service fees imposed by its telecommunications provider. No revenue sharing
or commission arrangement exists between the PCS and the telecommunications
provider in relation to any such transactions.

A Participant may make or change a tip for a given Match in a Round at any
time prior to the scheduled cutoff time of that Round.

Weekly winners will be
determined by the user's weekly score for the round
-
End of season winners
will be determined by total score, and then by ‘total number of correct
tips’, then by ‘Average Score’, then by ‘Average Tips’ then by Average of
Score/Tips
-
Tips for each game can
be entered or edited at any time prior to midnight of the first game date
for the round, published on the site as ‘Cutoff Time’. Under no
circumstances will tips be accepted after this time….

In the event that a prize winning Participant is unable to accept their
prize for whatever reason, or the prize is unable to be allocated, within
three (3) months of the results being determined, the PCS will award that
prize to the Participant who met the eligibility criteria and would have
been deemed the prize winner had the original prize winning Participant not
participated in the PCS Footy Tipping Competition .

Prizes (if any) and their values will be set out on the Web Site for the
relevant PCS Footy Tipping Competition depending on the prize pool and will
be exclusively determined by PhoneCardShop.
-
All prize winners will be notified by email and will be published on the
PCS’s Web Site upon determination.
-
The PCS reserves the right, at any time, to verify the validity of
registrations and tips and the eligibility of applicants and Participants
(including an applicant’s or Participant’s identity, age and place of
residence) and to disqualify any Participant who submits a registration or
tip that is not in accordance with these Terms and Conditions of Entry or
who tampers with the registration or tipping processes. Failure by the PCS
to enforce any of its rights at any stage does not constitute a waiver of
those rights.

Except for any liability that cannot be excluded by law, the PCS and its
agencies associated with this PCS Footy Tipping Competition (including
their respective officers, employees and agents) are not liable and do not
accept responsibility for:
a)
a Participant's tips
that are not received or which are received and subsequently corrupted or
rejected by the Web Site server, whether or not after receipt by the PCS;
b)
any lost,
misdirected or corrupt emails to or from the Web Site
c)
any loss or damage
whatsoever (including but not limited to direct, indirect or consequential loss)
or personal injury suffered or sustained in connection with a Participant’s
participation in the PCS Footy Tipping Competition or the taking of a prize or
otherwise relating to the conduct of the PCS Footy Tipping Competition , however
caused, including failure of the Web Site or incorrect or corrupt data supplied
by the PCS to a Participant;
d)
any theft,
unauthorised access or third party interference;
e)
any variation in the
value of any prize; or
f)
any tax liability
incurred by a Participant or prize winner.

As a condition of accepting any prize, the winner must sign any legal
documentation as and in the form required by the PCS and/or prize suppliers
in their absolute discretion, including but not limited to a legal release
and indemnity form.

Information about Participants is used by the PCS to assess and process
registration in the PCS Footy Tipping Competition . If an applicant does not
provide the required information, the PCS cannot process the registration.
All entries become the property of the PCS and will be entered into a
database. Information emanating from the Participant's participation in the
PCS Footy Tipping Competition is used by the PCS and its agencies
associated with this PCS Footy Tipping Competition for the determination of
winners and distribution of prizes, if any, awarded to a Participant.
Participants consent to publishing their name and Score in the results
section of the Web Site and as otherwise set out in these Terms and
Condition of Entry. The PCS will not be held responsible for any loss of
reputation, status or otherwise in connection with a Participant's tipping
selections and consequential results. It is a condition of entry that
Participants consent to these uses and disclosures of their information.
Information about Participants may also be used by the PCS, its agents,
contractors and related companies, for the purposes of carrying out
marketing, planning, product development and direct mail, telemarketing and
PCS Footy Tipping Competition al campaigns unless a Participant otherwise
withdraws their consent to the use of their information in this manner.

Notwithstanding the PCS's rights to not accept or to subsequently disqualify
a Participant, the PCS will not be liable for any legal action arising out
of any Participant’s name or postings on the Web Site being slanderous,
defamatory or unsightly to the public at large, except for any liability
that cannot be excluded by law. By participating in the PCS Footy Tipping
Competition , the Participant agrees to indemnify the PCS, its agents,
contractors and related companies from any legal action, claim or dispute
arising in relation thereto.

In the event there is a dispute concerning the conduct of the PCS Footy
Tipping Competition , the decision of the PCS is final and no correspondence
will be entered into.

The PCS shall not be liable for any manufacturer defects in prizes or for
any loss, damage or personal injury whatsoever which is suffered or
sustained (including but not limited to indirect or consequential loss) as a
result of taking a prize, except for any liability which cannot be excluded
by law.

As a member of the Web Site, the Participant agrees to receive one email per
week from PhoneCardShop.com.au that contains an advertisement. The
Participant can elect to be excluded from said emails however some Web Site
features may be made unavailable.
